JC Sim Supplies Ltd operates this online store and website (the “Website”), including all related information, content, features, tools, products and services, to supply a curated shopping experience (the “Services”).  The person accessing the website and accepting JC Sim Supplies Terms and Conditions is referred to as “you”, “your”, “client” and “customer”.   Party, Parties, or Us, refers to both the Client and ourselves, or either the Client or ourselves. 

Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same. 

JC Sim Supplies Ltd is powered by Shopify, which enables us to provide the Services to you.   The below terms and conditions, together with any policies referenced herein (these “Terms and Conditions”, "Terms of Service" or “Terms”) describe your rights and responsibilities when you use the Services.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.  

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide accurate representation of our products and services on our Website and social media channels. All reasonable care has been taken to ensure that the images, specifications and descriptions supplied for our products are accurate and detailed.   However, please note that colours or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

We may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.  

 

SECTION 3 - ORDERS AND CONTRACT 

By placing an order with JC Sim Supplies Ltd you are agreeing to a legally binding contract between you and us. 

  

Placing Your Order

By completing the checkout process on our Website, when you click the "Pay Now" (or equivalent) button, you are making a formal offer to purchase the products in your basket in accordance with these Terms. 

  

Acknowledgement of Your Order

After you place an order, you will receive an automated email from us acknowledging that we have received it. Please note that this email is an acknowledgement only and does not mean that your order has been accepted. 

 

Our Acceptance (Contract Formation)

Our acceptance of your order, and the formation of a legally binding contract between you and us, will only take place when we send you a separate email confirming the dispatch of the products in your order. 

Using a two-step confirmation provides legal certainty and protects both partiesIn UK e-commerce law it is a robust and standard practiceIt gives us the opportunity to reject an order before a contract is formed for reasons such as an inability to obtain authorisation for your payment, a description or pricing error or a product being out of stock. 

Please review your order carefully before submitting, as JC Sim Supplies Ltd may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.  

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or exportBy placing an order, you confirm that you are at least 18 years old and are legally capable of entering into a binding contract.

SECTION 4 – PRICES, TAXES, PAYMENT AND BILLING  

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. 

 

Payment Methods & Processing

We accept payment through Shopify Payments and PayPalShopify Payments supports major credit and debit cards for example, Visa, Mastercard, and American ExpressOther brands/cards may be supported but regional restrictions may apply, please see Shopify Payments terms and conditions for more information.   We also accept payments via Apple Pay and Google Play. 

Payment for your order, including all applicable delivery charges, will be debited from your chosen payment method at the time of, or shortly after, you place your order. 

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorised to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.  

 

Delivery Costs

The prices displayed for products do not include any delivery chargesOur available delivery options and associated costs will be calculated during the checkout process.  Delivery costs will be clearly displayed before you confirm your order. 

 

Order Locale, Relevant Taxes, Customs & Import Duties

UK Customers – for orders delivered within the United Kingdom, the prices displayed are the prices you payJC Sim Supplies Ltd is not VAT registered. 

International Customers: For orders delivered outside of the United Kingdom, the prices you see are the prices you payJC Sim Supplies Ltd is not VAT registered.   

For customers ordering from outside the United Kingdom, please be aware that the prices you pay to us are exclusive of any local import duties, taxes, or customs clearance fees. You, as the importer of record, are solely responsible for the payment of any such charges levied by the destination country. We have no control over any of these charges and cannot predict the amount. We recommend you contact your local customs office or government website for further information before placing your order. 

 

Price Changes

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation emailPrice changes will not affect any order which has been confirmed as dispatchedUnless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.  

Prices posted in our online stores may be different from prices offered in physical stores or in  other online stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.  

 

Pricing Errors

Every effort is made to ensure that the prices we display are accurate.   However, it is possible that, despite our reasonable efforts, some products may be incorrectly priced on the Website. If an error in the pricing of a product is discovered and you have placed an order, we will contact you to inform you of the errorWe will give you the option to cancel your order or continue to purchase the product at the correct price.   Your order will not be processed until we receive your instructionsIf we are unable to contact you using the details you supplied during the order process, we will assume the order is cancelled and we will notify you in writing.     

If the pricing error could reasonably have been recognised by you as a mispricing and/or is obvious and unmistakable, we do not have to supply the product(s) to you at the lower, incorrect price.  

 

  

SECTION 5 - SHIPPING AND DELIVERY  

All orders are handled in‑house from build to dispatch, which means dispatch timings can vary depending on workload. Items on the Website showing in stock and that are available to add to your basket are ready to ship.  We don't make money on shipping and just charge enough to cover the postage costs.

Pre-order or back-order items will be clearly indicated so you can base a decision on whether or not to order the item (if this option is available).  The terms around the purchase of these items (e.g. deposits, payments, estimated dispatch) will be clearly described on the Website product page. 

We truly value your custom and strive to meet our estimated dispatch/shipping times. We will indicate on the Website homepage any periods where it’s likely dispatch may be delayed (for example, holidays, event attendance or periods of high demand) and will supply a revised estimate of shipping time.  This will enable you to decide if you want to place an order with a likely longer than usual dispatch date.  

 

Delivery Company Shipping Estimates

Shipping dates and times are estimates, as provided by the delivery company, these are only a guide and are not guaranteed. Although we use reputable shipping providers, delays caused by the shipping provider, customs clearance or other unforeseen circumstances are beyond our control.   

Where the selected shipping option provides tracking and/or an estimated delivery date, this will be supplied to you on or just after your confirmation of dispatch.   

We are not liable for shipping and delivery delays. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our reasonable control.  

 

Shipping Options

Shipping options will be automatically displayed during checkout once your delivery address has been entered. These options may vary depending on your location, the size and weight of the items in your order.

International Dispatch and Delivery

We offer two options for international shipping, our Website (this webstore -  www.jcsimsupplies.co.uk) and our eBay store.  The products we offer vary per region and countries we ship to currently vary across our Website and our eBay store.  Clicking on the eBay link will take you to from this Website to our store on eBay's website.  Our eBay store is governed by eBay's policies and eBay's Terms of Service.

As outlined below if you place an order for delivery to a destination outside the United Kingdom, your order may be subject to import duties, taxes, and other charges imposed by the destination country. These costs are not included in our prices and are your sole responsibility. 

As outlined in Section 4, you are responsible for the payment of any such charges. You must also ensure compliance with all applicable laws and regulations of the country to which the goods are being delivered. We accept no liability for any breach of such laws by you or any third party acting on your behalf. 

International orders that dispatch via our website may have a slightly longer dispatch time that those using eBay's Global Shipping Program (GSP).  More information is below for both shipping options

 

International Orders via the Website (www.jcsimsupplies.co.uk)

If you place an order on our website for delivery to a destination outside of the United Kingdom, your order will be subject to import duties, taxes, and other charges imposed by the destination country. We do not include the costs for local customs/import duties, handling fees, taxes, or customs clearance fees in our prices and these are the customer's sole responsibility.  The price you pay on our Website will include the items and delivery cost only, your parcel will be shipped DDU (Delivery Duty Unpaid); and your local customs authority will be in touch to collect any relevant monies owed (this is usually prior to releasing the parcel). 

Please note:

  • We have no control over any local customs/import duties, handling fees, taxes, or customs clearance fees and cannot predict the amount. We recommend you contact your local customs office or government website for further information before placing your order.

  • JC Sim Supplies is not currently VAT registered in the UK. This means VAT is not included in our product prices as no VAT is being charged.

As outlined in Section 4, you are responsible for the payment of any such charges. You must also ensure compliance with all applicable laws and regulations of the country to which the goods are being delivered. We accept no liability for any breach of such laws by you or any third party acting on your behalf. 

 

International Orders via eBay

If you place an order via our eBay store for delivery to a destination outside of the United Kingdom eBay's Global Shipping Program (GSP) is used.  The price you see and pay on eBay should be the final price you pay for delivery to your door.  You may notice a slightly higher cost for items sold on eBay, this is to cover the platform fees we incur.   You may notice a higher shipping cost on eBay than on our Website, this is because there is a charge for the use of the GSP and the eBay shipping costs include local customs/import duties, handling fees, taxes, or customs clearance fees.

The GSP works by us sending your package to a Global Distribution Centre (GDC) in the UK.  From there eBay handles all of the customs paperwork and international shipping on our behalf and gets the parcel safely to you.

We have no control over the prices that eBay state/charge for shipping of a parcel via the GSP.  We have had great success from customers using the GSP and all additional charges should be covered in the price you have already paid.  If you choose to use eBay to purchase one of our products any issues with shipping from the GDC or additional charges incurred should be handled by and covered by eBay (we will support you if we can with this process).


Responsibility for the Products (Risk)

Responsibility for the products transfers to you once you, or a third party designated by you (excluding the carrier), take physical possession of the goodsThis is a legal requirement under UK consumer law. Any clause suggesting that risk transfers to the customer when goods are handed to the courier does not apply to consumer transactions in the UK. The Consumer Rights Act 2015 clearly states that the retailer remains responsible for the goods until they are safely received by the customer. 

 

All goods are securely packaged before leaving our premises. If damage in transit occurs please contact us as a matter of urgency via our support email (support@jcsimsupplies.co.uk) with details and photosWe will then advise you on the next steps and take this up with the delivery company. 

 

Ownership of Goods (Title)

Ownership of the products will transfer to you only once full payment has been received for your order, including any applicable delivery charges. 

 

SECTION 6 – YOUR RIGHT TO CANCEL (COOLING OFF PERIOD) 

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which apply to distance selling (such as online purchases), you have the legal right to cancel your order during the "cancellation period" (also known as the "cooling off period").

SECTION 7 – FAULTY GOODS 

Nothing in these Terms affects your statutory rights under UK consumer law. This section outlines your entitlements under the Consumer Rights Act 2015, which provides protection when goods are faulty. 

Under the Consumer Rights Act 2015, the goods we supply must be:  

Of Satisfactory Quality - goods should meet the standard that a reasonable person would consider satisfactory, taking account of any description, the price, and all other relevant circumstances. This includes aspects such as appearance and finish, freedom from minor defects, safety and durability.  

Fit for a Particular Purpose - the goods should be fit for the intended purpose they are supplied for and also fit for any specific purpose that you made known to us before you agreed to the purchase/contract.  

As Described - the goods supplied must match the description, sample, or model as advertised at purchase or presented at point of sale.  

If your goods do not meet these standards, there is a tiered system of remedies available that you are entitled to: 

  

Tier 1: Short-Term Right to Reject (0–30 Days)

You have the right to reject faulty goods and receive a full refund within 30 days of taking ownership. This is known as the “short-term right to reject”.  For the short-term right to reject the goods must be returned to us and we will ensure a refund is processed without undue delay. 

  

Tier 2: Repair or Replacement (After 30 Days, Within 6 Months)

If a fault arises after the initial 30-day period but within six months of you owning the product, you must allow us one opportunity to repair or replace the item. You may express a preference, but we may choose the alternative if your choice is impossible or disproportionately expensive. During this period, any fault is presumed to have existed at the time of delivery unless we can prove otherwise. 

If we can’t repair or replace the goods (for example, it’s out of stock or can’t be fixed), or the repair is unsuccessful, you may be able to claim a full or partial refund (this is the “Final Right to Reject”).  Any refund may be subject to deductions for the use you had of the product.  However, we will discuss all available options with you. 

 

Tier 3. Our Obligations After 6 Months

For the first six months, the law generally assumes any defect or problem existed at the time of sale (unless we can prove otherwise). After that, you can still seek repairs, replacements, or refunds, but the burden of proof falls to the you to show that the issue wasn’t “wear and tear” or a result of misuse. 

 

Reporting a Faulty Product

If you have received a faulty product the best thing you can do is get in touch with us as a matter of urgency via email: support@jcsimsupplies.co.uk or using our web form: Warranty, Cancellations & Returns Form 

If you're sending an email please supply your full name, contact details, order number, details of the fault/defect and a valid proof of purchase (for example, a receipt or invoice).

These Terms permit you to use the Website and Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Website and Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of JC Sim Supplies Ltd, Shopify or any third party. Unauthorised use of the Website and Services may be a violation of  intellectual property laws. All rights not expressly granted herein are reserved by JC Sim Supplies Ltd.

JC Sim Supplies is powered by Shopify, which enables us to provide the Website and Services to you. However, any sales and purchases you make in our Store are made directly with JC Sim Supplies. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and JC Sim Supplies, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with JC Sim Supplies.

Cap on Liability

Subject to the clauses above regarding liability that cannot be excluded, our total liability to you in respect of all other losses arising under or in connection with the contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no circumstances exceed the total price of the products you have purchased under the relevant order.   

 

Supply of Goods

JC Sim Supplies shall not be liable towards the buyer for any indirect, consequential, special punitive or incidental loss or damage and cannot accept responsibility for any damage, injury or loss arising from the purchase or use of these items (subject to the clauses above regarding liability that cannot be excluded).   This includes injury or damage caused while installing or using our products, to either the user, the user's property or to any third-party person or third-party property, whether the products are defective or not (subject to the clauses above regarding liability that cannot be excluded).    

 

By the nature of the products we sell, the configuration of your system and other devices can cause problems. Although we will try to help with these, we cannot be held responsible for issues relating to Windows drivers and conflicts with other devices and any loss of data or damage to your computer (hardware, operating system or software) or racing setup (rig, hardware and peripherals). 

 

The products we supply are to be used at your own risk and in line with the manuals, guidance and warnings supplied by us (verbal or written). All items sold are tested before dispatch.
